At the 9th meeting on November 7, 2009, the Bar Council, and after much discussion on the problems faced by lawyers with the current state of affairs, will be calling an EGM on December 12. The EGM will, among others, discuss issues on how cases are being handled by the Judiciary.
Chua is still suspended, Dismissal of the 4 Central Committee MCA Members is unconstitutional
Roger Tan deftly analyzes the recent developments in the MCA debacle in light of the confirmation of Datuk Seri Ong Tee Keat and Dr. Chua Soi Lek as the President and Deputy President.
Can Islamic issues be discussed without the permission of the religious authorities?
However, while the non-Muslim does not have to seek prior approval to organize talks or seminars with regards to his religion, the Muslim citizen appears to have this added hurdle to cross in order to exercise his rights under Article 10 and Article 11 (1). Is this constitutional? Is this legal? I will not ask the question if this hurdle is consistent with the Quran since it is not (my humble view – stand to be corrected). – www.LoyarBurok.com
Pusing-Pusing MCA
After all that, MCA is now back to square one. We had the President sacking the Deputy. We then had the Deputy retaliating and demanding for an EGM. The President’s men also put in a few motions. It was narrowed down to 3 motions. They then fought it out on 10th October 2009. The President […]
The Perak Crisis: Keep Focused on the Real Issues
On 11 May 2009, the Kuala Lumpur High Court ruled (per Dato’ Abdul Aziz J) that since there had been no formal vote of confidence on the floor of LA, Nizar remained the rightful MB of Perak. Zambry appealed. The Court of Appeal unanimously reversed the High Court decision but it was some time before the three judgments were released. Two of them, those of Dato’ Raus Sharif and Dato’ Ahmad Maarop JJCA were released towards the end of June while that of Dato’ Zainun Ali JCA was released in early July.
The three lengthy judgments come up to some 240 pages in all and a large number of issues were canvassed and discussed. Dr Kevin YL Tan SJD previously commented on the correctness of the High Court decision and having already discussed the contradictions that arose from the judgments of Raus and Maarop JJCA feels it is timely to revisit the most salient issues in this case.
1 World, 1 Malaysia…different planet
Imagine you are an alien being from some planet far far away in the globular star clusters M80, 23,000 light years away from Earth. You had just arrived on Earth after traveling in a space craft called Pro-Ton, your premier national space craft manufacturer. You have traveled 23,000 light years to be here. You are […]
3 dead girls in 1Malaysia
What is this 1 Malaysia camp at Kuala Dipang in Perak? If not for that unfortunate death of the 3 girls, many of us wouldn’t know of this camp. How can the Government even consider sending kids as young as that age to camps, to teach about this concept called 1 Malaysia, which until now […]

Datang lah, tak perlu bayar :) www.LoyarBurok.com
Mengapa saya ingin sebarkan… Kempen PerlembagaanKu
Saya tersentuh… Writer’s block. Is that what you call someone who wants to write but nothing flows out of the swish of the pen or the tap-tapping of the keyboard? A friend suggested to write in the Malay language but it’s been a while since I did that… probably in high school. Still it’s no […]

Chin Peng: A Question of Honour
I happened to be in Bangkok a fortnight ago where Mr B. H. Ong or better known as Chin Peng was being interviewed by some members of the Malaysian and Singapore Press. It became an opportunity to meet and converse with a historic figure, now at the age of 85. He was cordial and responded […]
Conversations on the Constitution: Anand Grover and the Right to Health
Yeoh Yen Kee Recently, I came across news about 19-year old, Yeoh Yen Kee. She obtained 11As for SPM, and was to pursue her dream to study medicine. She was awarded a scholarship to study in the Czech Republic. However, in 2008, she was diagnosed with leukemia and could not proceed with that plan. After […]
Zul Noordin and PKR – the lame and the lamer
Zul Noordin fashioned himself as the defender of Islam. I do not have any qualm if anybody wants to defend his marbles and his pussies. But if by defending Islam it means that he could impose his personal values and beliefs on me and others, well, I bleeding well have a problem with that!
If we are going to screw this country up, why not start at school?
On 22nd October 2009, many were absorbed in reading the news about MCA’s attempt to resolve its internal fights. At the same time, 2 major items of news were overshadowed by that MCA story. First, the decision of our 1Public Prosecutor, the Attorney General, to close VK Lingam’s case despite the proposal of the Royal […]

1Wrong Malaysia: No prosecutions in Lingamgate
About 2 years ago, a friend e-mailed a video link of a man on the phone mentioning names of people in the Judiciary. I instantly recognised the man as VK Lingam. (Much later, there was a second video link of the second half of the conversation.) But I am not a 1Video Forensic Expert, so I could be wrong.
Chin Peng: The Heart of the Dispute
The issue of Chin Peng recently cropped up again. For the second time running, the court blocks an attempt to have Chin Peng’s side of the story litigated. Hanif Omar and Rahim Noor are divided. Now, let us go back to some basics, and you decide for yourself:
Stop the Repatriation of the Sri Lankan Refugees Now!
SUARAM’s urgent appeal on the plight of Sri Lankan refugees who complain they are being illtreated by Malaysian officials is reproduced below. Sri Lanka’s government has been accused of grave war crimes and humanitarian abuses. Despite that, it appears that the Malaysian government is assisting fficials from the Sri Lankan High Commission repatriate ethnic minority Tamil asylum seekers from Sri Lanka who fear for their lives at the hands of the Government of Sri Lanka. About 300,000 Tamils still live behind barbed wires in internment camps in Sri Lanka, unable to return to their homes since the end of the civil war earlier this year. Please respond to this urgent appeal by circulating the same, and sending the suggested letter of protest (at the end of the post) to the authorities.
In the Beginning… the MyConstitution (PerlembagaanKu) Campaign Trail
These past few months have been immensely hectic. The Malaysian Bar is extremely fortunate to have a pool of incredibly talented, young and energetic group of lawyers, pupils-in-chambers, and students working night and day on this Campaign. From the words “let’s move”, the action has been continuous, non-stop, and it has been difficult to keep […]
