Wan Ismail (no relation to anybody, whether dead or alive) was born in Melaka. His father comes from Kelantan. His mother from Melaka. When he was 17, his parents divorced. He followed his father and lived in Kelantan. He is of course a Muslim.

While in Kelantan, he sometimes went across the river to Golok for some earthly fun, like drinking alcohol and fornication with some women. But when in Kelantan, he fervently prayed and fasted. Wan Ismail now lives in Penang but he frequently commutes between Penang, Kuala Lumpur and Kota Bharu.

Wan Ismail established a private limited company (Hambo Gomo Sokmo Sdn Bhd) and registered the company in Kuala Lumpur. The company has an office in Kuala Lumpur as well as places of business in Kota Bharu, Johor Bharu, Alor Star and Singapore. It also have bank accounts in those towns.

The shareholders and the directors of Hambo Gomo Sokmo S/B were Wan Ismail himself, his friend, Ali Serbat and Ashton Ang Lai Leng. Ali Serbat was a Pakistani from Pakistan. Ashton Ang, a Christian, was from Kuala Lumpur.

Hambo Gomo’s business grew and there were some money in those accounts. Each of the shareholders have cheque books and ATM card for those accounts.

Wan Ismail withdrew a lot of money from the Kuala Lumpur accounts. These withdrawals went unaccounted. He also went to Singapore to withdraw money. Ashton Ang said Wan Ismail withdrew money in Singapore to go to the casino as well as karaoke in Singapore.

Fed-up with Wan Ismail’s antics, Ashton Ang lodged a police report in Singapore as well as Kuala Lumpur against Wan Ismail for thefts and criminal breach of trust.

Ali Serbat was also furious. He lodged a report against Wan Ismail in Kelantan at the Syariah Enforcement office.

The Singapore commercial affairs department completed their investigation and wanted to charge Wan Ismail in Singapore. The Singapore government made an extradition request to the Malaysian government.

The Kuala Lumpur police also completed their investigation. The Attorney General wanted to charge Wan Ismail in the Kuala Lumpur Sessions Court.

The Kelantan Syariah enforcement unit also wanted to charge Wan Ismail under the Kelantanese Hudud Enactment in Kota Bharu.

Meanwhile, Hambo Gomo Sokmo Sdn Bhd launches a civil suit against Wan Ismail for fraud, breach of trust and breach of fiduciary duties in the Kuala Lumpur High Court.

Wan Ismail comes to you for legal opinions and advice.

Advise him on the following:

i) Which Courts have jurisdiction over the matters;

ii) What Constitutional issues arise from the matters; and,

iii)What are the possible Constitutional solutions in the matters.

  2. I am not a lawyer, so I would not be able to advise Wan Ismail.
    However, I would like to place myself in Wan Ismail's shoes and were in Aston Paiva's office seeking legal opinions and advice to my legal woes as Art had put it. I can see Aston talking to the wall and getting no payment from me, as I would have walked out before he has a chance to finish giving his opinions, if what he has written is his advice to me as a potential client.

  3. By the wisdom of Ostad Ashton and the superiority of divine law, it would be expedient for Wan Ismail's business partners to also furnish evidence of his nocturnal visits to Golok, the casino escapades, and misappropriation of monies.

    Wan Ismail may be at the receiving end of stones. If the enforcement officers use batu kapur instead of batu bata for his stoning, he may end up as an OKU after the amputation of his hands. This divine retribution is a cheaper and express way to wind up Wan Ismail for his manifold breaches. Hence, there will be less paperwork and great savings on legal costs incidental to bankruptcy proceedings, interlocutory proceedings, winding up proceedings, etc. Choose hudud for Wan Ismail's sins.

        Contextual approach:
        The judgement says, its inappropriate to use the word in Christian publication. (argument for this-on another day,). I does not it any manner say its exclusive.

        Now, please stop misleading.

        The appellate judges were not supposed to preach, even if they'd wish to preach, they should leave it to the parliament to decide. Not usurping parliamentary powers.

    Sebagai seorang Melayu Muslim, Encik Azhar patut tahu bahawa Malaysia ini merupakan sebuah negara Islam di mana Islam itu merupakan ad-din iaitu merangkumi kesemua sudut hidup manusia termasuklah perkara-perkara awam, perundangan, politik, ekonomi, sosial, kebudayaan, moral dan kehakiman.

    Ternyata daripada keputusan Mahkamah Rayuan dalam kes Menteri Dalam Negeri & Ors v Titular Roman Catholic Archbishop of Kuala Lumpur [2013] 6 MLJ 468 baru-baru ini:-

    "[104] I would add however that the position of Islam as the religion of the Federation, to my mind imposes certain obligation on the power that be to promote and defend Islam as well to protect its sanctity."

    Dengar tu Encik Azhar. Mahkamah Rayuan dah kata dah tu. Apa lagi yang Encik nak bagi konundrum la, kondom la, hipotetikal la, hipotermia la, itulah, inilah.

    Soalnya mudah sahaja, ini negara Islam. Sebuah undang-undang mestilah berlandaskan Syariat Islam. Jadi, Encik Wan Ismail ini mestilah didakwa di bawah undang-undang Islam. Isu berkenaan pendakwaan di Kuala Lumpur atau Singapura tidak menjadi hal. Pendakwaan itu boleh diteruskan seperti biasa kerana itu merupakan undang-undang manusia. Tetapi dibawah undang-undang Islam iaitu undang-undang Allah S.W.T., Encik Wan Ismail harus disabitkan dengan kesalahan yang sewajarnya dan dikenakan dengan hukuman yang setimpal termasuklah disula atau direjam. Adalah jelas bahawa 'Islam is a religion of Peace'.

    Itu sahaja jawapan saya pada kali ini.

    Saya turut ingin memberikan pandangan saya kepada bahasa Encik Azhar. Encik Azhar patut tahu bahawa bahasa Melayu itu merupakan bahasa kebangsaan dan Encik Azhar sebagai seorang Melayu perlu menggunakan bahasa tersebut dan bukannya apa-apa bahasa barat yang dengan jelasnya tidak sebati dengan budaya Melayu di Malaysia. Janganlah Encik Azhar menjadi seorang yang munafiq. Nama sahaja Melayu tetapi tidak tahu, atau malu, berbahasa Melayu.

    Saya juga ingin menasihati Encik Azhar untuk tidak membangkitkan soal-soal yang boleh mencabar Hukum Hudud ataupun Islam. Terdapat kebimbangan yang sebenar oleh saya bahawa soal-soal yang telah dibangkitkan oleh Encik Azhar dalam artikel dengan atas mencabar kesucian Islam. Jangan sekali-kali Encik Azhar menjadi fasiq kerana lama kelamaan akan murtad.

  6. Hullo! Islamic Law take precedence over every other man-created law! The Islamic authorities will fight tooth and nail to enforce its hudud on Wan Ismail. No Muslim lawyer of judge dare go against God's Laws. Huh?
