Yet another lawyer intimidated for doing his job. When will this end? Never …unless the people stand up, unless we see naked abuse of power for what it is and call it as it is, and when we start demanding only the highest of standards from those who wield power and authority.

Lawyers For Liberty's N. Surendran

Two days ago, my friend and Lawyers For Liberty‘s N. Surendran was issued with a RMAF letter (read: threat) dated 28 October 2010. The RMAF “advised” Surendran to advise his client to do something which Surendran would never do – surrender to the RMAF.

Surendran’s client is a former RMAF sergeant currently facing a criminal charge for allegedly being involved in the jet-engines fiasco. In the course of carrying his duties as a lawyer, Surendran raised numerous issues regarding the fiasco and also in relation to the manner in which the RMAF had treated his client while under investigations.

For acting without fear and favour, Surendran has been issued with what appears to be a threat.

On one previous occasion there were 100 or more lawyers offering to be part of LoyarBurok’s Team 100 to protect the Bar Council’s MyConsti campaigners in face of a police report lodged by a misguided group. I hope the same individuals and others who are reading this will rise and put a stop to RMAF’s unacceptable act of intimidation against Surendran and his client.

Surendran is not just a lawyer but a dear friend of mine and I would like to make it known to all and sundry that any act of harassment or intimidation of him, is an act of harassment and intimidation of me and members of the Malaysian Bar.

Surendran was merely doing what any right-minded lawyer would do. It is quite obvious that there are some people in the upper echelons who are unhappy with the manner he is carrying out his duties. RMAF’s conduct is an attack on the fundamental right of a person to be represented by a lawyer.

This is a clarion call for members of the Bar and fellow Malaysians to unite and stand up together. Together we must send a strong message to the powers that be that we do not accept this kind of behaviour.

So to those who are reading this: “Who will stand by Surendran’s side?” I definitely will. If you would join me, list your name below.

  2. For too long we allow Corruption by those in power to continue stealing billions of our money-Mahathief, Khir Toyol, Taib Mahmud etc.

    And for too long the Judiciary & Enforcement agencies are being influenced and Police a law unto themselves.

    We must not forget Kugan, Amirul,Gunasegaran -his witness K.Selvachandran who saw him being kicked in the chest by Lancs Corporal Mohd. Faizal Mat Taib, and now being detained by Police after being arrested on trump up charges and beaten infront of his wife and children for daring to testify against the Police !

    and all others who have died in custody and not forgetting Altantuya, Beng Hock ………the list goes on !!!

    We must stand together to say NO and be counted for to say or do nothing is not an option if we do not want Malaysia to slide into a Police State.

  3. Mr. Teo's post raises an interesting point and, like him, I do wonder about certain details of the whole affair – although that is more to do with me not keeping up with the very latest news.

    That aside, however, if the allegations (reported elsewhere) of Sgt. Tharmendran being tortured by RMAF offciers during their internal "investigations" are true, then this "advice" to Mr. Surendaran (which reads more like an LOD) is yet another reflection of the state of the security services in this country these days: descending into little more than state-backed thugs. With guns. And planes.

    After all, with the Government's recent lavish spending on the armed and police forces (isn't the country supposed to be headed for bankruptcy soon?), they certainly know which side their bread is buttered on!

    The Provost can only act under Military Law – if Su's client has breached the "Military" laws , then the ADJUTANT GENERAL can issue a w/a – but I believe SU's client has been "relieved/sacked…., from the Military!!!

    In any event, S 126 EA applies!

    I have faced too many FRU confrontations, tears gassing & all and am the present time, having to keep an eagle eye on my mother in law , who suffered a stroke recently.

    Surendran is one crazy lawyer – I have said it to him myself BUT

    man do we need more like him -THE LEGAL PROFESSION, I mean.

    U & Him make me proud of the profession I walked away from.

  5. Correct me if i am wrong but is this not the RMAF's notice to produce the sergeant who is AWOL before commencing court-marshal proceedings? how is it a threat?
